The media has been portraying Trump like he is under siege, with Democrat prosecutors having him cornered on all sides.
But in reality, Trump has been effectively fighting back against the witch hunt Joe Biden’s friends and allies are launching against him.
He knows that they don’t have the goods on him, and that’s why he has been able to deny his prosecutors the legal victories that they were hoping for at this stage of the case.
This is a huge problem for Democrats, as they have been banking on Trump being convicted and in jail by the time the 2024 election rolls around.
They know that may be their only hope of getting Joe Biden back in office for one more term.
But things have gone sour for them, and they may need to reevaluate their plans.
Trump has struck back against them with a brilliant legal maneuver that could lead to all of his charges being dropped.
According to Axios, “Former President Trump said Monday he’ll attend a federal appeals court hearing in Washington, D.C., this week on his claim that he has presidential immunity from prosecution.”
“Republican presidential primary front-runner Trump has made the legally untested argument that he should have ‘absolute immunity’ from charges that he plotted to overturn the 2020 election — one of four criminal indictments he faces.”
Trump is making the argument that the things Democrats are trying to charge him with occurred as part of his official duties.
A separate Axios article from October laid out how this works, saying: “Trump’s lawyers argue that he has absolute immunity from criminal prosecution for actions that were performed within the ‘outer perimeter’ of the president’s official duties.”
This makes perfect sense, as no other president before Trump has ever been charged with a crime after leaving office.
Here is what the lawyers stated in the motion: “Breaking 234 years of precedent, the incumbent administration has charged President Trump for acts that lie not just within the ‘outer perimeter,’ but at the heart of his official responsibilities as President. In doing so, the prosecution does not, and cannot, argue that President Trump’s efforts to ensure election integrity, and to advocate for the same, were outside the scope of his duties.”
Trump’s prosecutors were certainly not expecting him to fight back with a motion like that, and he may well succeed at getting a judge to agree with him and demand that the charges be dropped.
After all, prosecutors have already failed in their attempts to get the Supreme Court to weigh in on the case.
